Role Purpose:
To manage legal due diligence, title verification, mortgage creation, and legal risk assessment for Construction Finance proposals. The role involves ensuring compliance with legal and regulatory requirements, providing legal support to business teams, and minimizing legal risks associated with lending transactions.
Key Responsibilities:
Legal Due Diligence & Property Verification
- Conduct legal scrutiny of property and project-related documents for Construction Finance cases.
- Verify title documents, ownership records, chain of title, encumbrances, and statutory approvals.
- Prepare legal search reports and provide legal opinions on financing proposals.
- Assess risks related to land acquisition, project approvals, and litigation.
Construction Finance Assessment
- Review approvals, licenses, permissions, and regulatory compliances related to construction projects.
- Examine development agreements, joint development agreements (JDA), collaboration agreements, and other project documents.
- Evaluate mortgageability and enforceability of security offered by borrowers.
- Ensure compliance with RERA and other applicable laws.
Documentation & Mortgage Creation
- Vet loan documents, security creation documents, and related legal agreements.
- Coordinate for equitable mortgage creation, registration, and charge creation.
- Ensure proper documentation and safe custody of original legal documents.
Eligibility Criteria:
- Qualification: LLB / LLM from a recognized university.
- Experience: 5-10 years in Legal, preferably within Construction Finance, Mortgage Loans, Housing Finance, NBFC, or Banking sector.
- Strong knowledge of property laws, mortgage laws, registration processes, RERA, SARFAESI, DRT, and related regulations.
